TBS Client Sues Barnes & Noble Claiming its Nook E-Readers Infringe on Client\'s Patents

TBS client Deep9 Corporation has sued Barnes & Noble alleging that Barnes & Noble's popular Nook and Nookcolor e-readers infringe on Deep9's patents. The complaint alleges that the Nook, the best selling item in Barnes & Noble's nearly 40-year history, infringes on Deep9's patents for the invention of a novel method for updating an online database over a network. Deep9's founder, David Campbell, obtained the patents beginning in 1999. Deep9 is represented by Tousley Brain Stephens attorneys Kim Stephens, Mark Deife and Chase Alvord, attorneys Jonathan Selbin and Eric Fastiff of the San Francisco-based firm, Leiff Cabraser Heimann & Bernstein LLP, and the Law Office of Christian E. TBS obtains $2.6 Million Construction Defect Settlement for Condominium Residents

Pacific Center is a 50-unit residential condominium in the International District. The condominium shared a building with a retail condominium owned by the developer. In 2008, TBS attorney Chase Alvord, as co-lead counsel, filed suit against the development company and its individual owners for construction defects and mismanagement of the residential condominium association. After two years of litigation, the case settled one month before trial for $2.6 million. These settlement funds will allow the residents to undertake much-needed, major repairs to the building.

TBS Attorneys Obtain Preliminary Injunction Prohibiting Trust from Executing on Judgment

In a highly contentious trust and estate dispute, TBS attorneys Janissa Strabuk and Paul Moomaw recently obtained an order prohibiting a trust from executing on a judgment it had obtained against a family corporation. Our clients, shareholders in the corporation, argued that the judgment was obtained as part of a conspiracy between several of our client's siblings to wrongfully deny him and another sibling their rightful inheritance. The court also ruled that any assets of the corporation could be sold only by agreement of all of the siblings or by a receiver if the siblings could not agree. The court agreed with our clients that the proceeds from the sale of any corporate assets should be held by the court or in a neutral account until the disputes between the parties are resolved.
